Terms and Conditions

This is a convenience translation. The German version is legally binding.

§ 1 Scope

These General Terms and Conditions (T&Cs) apply to all contracts for participation in classes, the purchase of passes, vouchers and memberships, and the rental of rooms of Yogaschule Zehlendorf, owner Laura Brauer, Riemeisterstraße 114, 14169 Berlin (hereinafter the “Yogaschule”). Any deviating terms of the customer shall not apply unless their validity has been expressly agreed to.

§ 2 Services

The Yogaschule offers yoga, Pilates and meditation classes, private sessions and room rental. The scope and content of the classes are set out in the current class description or class schedule. The Yogaschule is entitled to adjust class content, class times and the teachers deployed for objective reasons.

§ 3 Registration and conclusion of contract via Eversports

Classes are booked and passes and memberships purchased as a rule online via the Eversports booking system or on site. By making a booking in the booking system, the customer submits a binding offer; the contract is concluded upon confirmation by the Yogaschule or the booking system (booking confirmation). Use of the booking system requires the creation of an Eversports customer account; the terms of use of Eversport GmbH additionally apply to the customer in this respect.

§ 4 Prices and payment

The prices shown on the website or in the booking system at the time of booking apply. All prices include statutory VAT where applicable. Payment is made via the payment methods offered in the Eversports booking system – in particular SEPA direct debit, credit card and PayPal – or, by arrangement, on site (in cash or by debit card). Payment processing is handled by Eversports or the payment service provider used by Eversports.

When paying by SEPA direct debit, you grant a SEPA direct debit mandate in the booking system and confirm that you are authorised to have payments collected from the specified account. Fees for ongoing memberships are collected at the beginning of each month. If a payment fails due to insufficient funds or for reasons for which you are responsible, the resulting bank charges may be passed on to you.

§ 5 Memberships: term, renewal and termination

The minimum term of membership contracts (e.g. “Unlimited”, “4× per month”) is 12 months. After the minimum term has expired, the contract is extended for an indefinite period and may be terminated by either party at any time in writing (e.g. by email) with one month’s notice. Termination at the end of the minimum term is also possible with one month’s notice.

In special cases, the membership may be paused for up to eight weeks. This includes extended unplanned absence, illness or circumstances that demonstrably prevent participation in classes. An upgrade of the membership is possible at any time. The right to extraordinary termination for good cause remains unaffected.

Price guarantee: As long as your membership continues without interruption, the prices agreed at the start of the contract continue to apply to you.

§ 6 Multi-class passes and trial class

Multi-class passes (e.g. 10-class pass) are valid for 10 months from the date of purchase; unused units expire after this period. The discounted trial class may be used once per person.

§ 6a Vouchers

(1) The Yogaschule issues gift vouchers, which can be purchased online via the booking system or on site at the studio. Vouchers can be credited towards all open classes of the Yogaschule. They cannot be redeemed for third-party services (e.g. Urban Sports Club, ClassPass) or for room rental.

(2) Upon receipt of payment, the voucher is sent to the purchaser by email with an individual voucher code. Redemption via the booking system requires an Eversports customer account; on site at the studio, providing the code is sufficient.

(3) Vouchers are transferable. The Yogaschule is entitled to render performance with discharging effect to the person presenting the voucher code, provided there are no indications of unauthorised use.

(4) The voucher value may be redeemed in partial amounts; any remaining balance is retained until the voucher expires. Cash payment of the voucher value or of any remaining balance is excluded. Vouchers do not bear interest.

(5) Vouchers are valid for three years, calculated from the end of the year in which the voucher was purchased. This corresponds to the standard limitation period under §§ 195, 199 of the German Civil Code (BGB).

(6) If a voucher is credited towards a multi-class pass, the validity period of that pass under § 6 begins on the day of redemption.

(7) If the voucher code is lost, a replacement can only be provided if the purchase is proven and the voucher has not yet been redeemed.

(8) The right of withdrawal under § 12 of these T&Cs applies to vouchers purchased online.

§ 7 Cancellation and no-show

Booked class places may be cancelled free of charge via the booking system up to 24 hours before the start of the class. In the event of later cancellation or no-show, the booked unit is forfeited. The cancellation rules stored in the booking system are decisive.

§ 8 Holidays and public holidays

On public holidays and during the Berlin school holidays, a reduced class schedule may be offered. There is no entitlement to an unchanged scope of classes on these days; ongoing memberships remain unaffected.

§ 9 Room rental

The conditions and prices stated on the “Room rental” page apply to the rental of rooms. The rooms must be treated with care and returned in the agreed condition. Final cleaning can be booked as an add-on. The tenant is liable for damage caused by the tenant. Details (booking, payment, cancellation) are governed by the respective rental agreement or booking confirmation.

§ 10 Participation and health

Participation in classes is at your own responsibility and at your own risk. Yoga and Pilates are no substitute for medical or therapeutic treatment. In the case of health restrictions, pre-existing conditions or pregnancy, medical advice should be sought before participating. Please inform the teacher of any relevant complaints before the class.

§ 11 Liability

The Yogaschule is liable without limitation for damage resulting from injury to life, body or health, and for intent and gross negligence. Otherwise, the Yogaschule is liable only for breach of a material contractual obligation and limited to the foreseeable damage typical of the contract. No liability is accepted – except in the aforementioned cases – for the loss of or damage to items, valuables or money brought to the class venue.

§ 12 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal for contracts concluded online. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us (Yogaschule Zehlendorf, Laura Brauer, Riemeisterstraße 114, 14169 Berlin, email: info@yogaschule-zehlendorf.de) of your decision by means of a clear statement.

Note on early expiry: If you expressly request that a booked service (e.g. a class) begins before the withdrawal period has expired, the right of withdrawal may expire early once the service has been performed in full; in the case of partial use, proportionate compensation for the value received is payable.

§ 13 Amendments to the T&Cs

The Yogaschule reserves the right to amend these T&Cs with effect for the future, insofar as this is objectively justified and reasonable for the customer. Customers will be informed of amendments in an appropriate manner.

§ 14 Final provisions

The law of the Federal Republic of Germany applies. Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
